Service.

The terms that govern the relationship between Caption Legal and the clients, law firms, and insurance entities engaging our litigation-support services.

Before the assignment

Accurate scheduling, case, location, consent, and service details are required.

After the assignment

Billing, delivery, licensing, and retention follow the terms below.

By booking a service or accessing this website, the client, law firm, or insurance entity engaging Caption Legal agrees to be bound by these Terms of Service.

Scope of services

Caption Legal provides professional litigation-support services nationwide. Depending on the confirmed assignment, services may include:

Legal videography

In-person, remote, and hybrid deposition recording, including Zoom and Google Meet proceedings.

Medical videography

Independent, compulsory, and defense medical examination documentation, including IME, CME, and DME assignments.

Post-production

Transcript synchronization, forensic video editing, and trial-ready clip creation.

Strategic media

Day-in-the-life legal video production and trial technician services.

Coordination services

Assistance identifying third-party interpreters and court reporters.

Independent court reporting disclaimer

Caption Legal is not a court reporting firm, agency, or provider of certified shorthand reporting services.

Coordination only

Any identification or referral of a court reporter is provided solely as a convenience.

Direct contract

Court reporters are independent professionals who contract directly with the client.

Independent responsibility

Caption Legal does not supervise, control, or guarantee a third-party reporter’s work product, accuracy, or availability. Billing for stenographic services is handled independently of Caption Legal.

Client responsibilities and conduct

  • Booking accuracy: The client must provide accurate case captions, assignment locations, and start times.
  • Notices and consents: The client is responsible for serving required deposition notices and obtaining necessary legal consents for recording, particularly for IMEs involving sensitive medical examinations.
  • Remote exhibits: For remote proceedings, the client is responsible for managing and sharing digital exhibits unless a Caption Legal trial technician has been specifically retained for that purpose.

Medical examinations

For IME and CME videography, Caption Legal follows a neutral-observer standard. Videographers document the examination from arrival through departure within the permitted assignment scope.

Privacy

Caption Legal complies with applicable HIPAA standards when handling medical video data.

Conduct

Videographers do not interfere with the medical examination and maintain a clear view as permitted by law or court order.

Cancellation and rescheduling

Legal proceedings are subject to frequent change. To maintain nationwide service availability, assignments cancelled within 24 business hours of the scheduled start time are subject to a late-cancellation fee, plus any non-refundable travel expenses already incurred.

Payments and billing

Invoice terms

Due within 30 days

Invoices are due within 30 days of the invoice date.

Nationwide travel

Approval before assignment

Applicable travel fees, per diems, or lodging costs will be disclosed to and approved by the client before the assignment.

Intellectual property and data retention

Client license

Upon full payment, the client receives a non-exclusive license to use the recorded content for the underlying legal matter. Caption Legal retains the intellectual property rights in its proprietary synchronization and editing methods.

One-year retention period

Caption Legal retains copies of video records for one year from the proceeding date. After that period, files may be destroyed unless the client requests extended storage in writing for an additional fee.

Limitation of liability

Caption Legal uses professional equipment and redundancy protocols, including backup recorders. Unforeseen equipment failure, data corruption, acts of God, or other events outside reasonable control may nevertheless occur.

Cap on liability

Total liability for a claim will not exceed the amount paid by the client for the specific assignment at issue.

No consequential damages

Caption Legal is not liable for lost profits, case outcomes, or legal fees resulting from technical issues or service delays.

Confidentiality

Caption Legal maintains work-product confidentiality. Recordings and case data are released only to the hiring party, authorized co-counsel, or as required by a valid subpoena or court order.

Governing law

These terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law principles. Disputes will be resolved in the courts of Albuquerque.
