(a) When Depositions May Be Taken: In New Mexico, any party may take the testimony of any person, including a party, by deposition upon oral examination without leave of court, except as provided in Rule 1-030(A)(2). The attendance of witnesses may be compelled by subpoena as provided in Rule 1-045.
(b) Notice of Examination; General Requirements; Method of Recording; Production of Documents and Things; Deposition of Organization:
(1) Notice in General: A party desiring to take the deposition of any person upon oral examination must provide reasonable notice in writing to every other party. The notice must state the time and place of the deposition, and the name and address of each person to be examined, if known. If the name is not known, a general description sufficient to identify the person or the class or group to which the person belongs must be provided.
(2) Method of Recording: The notice must specify the method by which the testimony will be recorded. Unless the court orders otherwise, the testimony may be recorded by audio, audiovisual, or stenographic means, with the noticing party bearing the cost of the recording. Any party may arrange to have a transcription made from the recording.
(4) By Remote Means: The parties may stipulate—or the court may order—that a deposition be taken by telephone or other remote means. For the purposes of this rule and related rules, the deposition takes place where the deponent answers the questions.
(a) Within the United States: Within the United States or any territory or insular possession subject to U.S. jurisdiction, depositions must be taken before: (1) an officer authorized to administer oaths by the laws of the United States or of the place where the examination is held; or (2) a person appointed by the court in which the action is pending to administer oaths and take testimony.
(b) In a Foreign Country: A deposition may be taken in a foreign country: (1) under an applicable treaty or convention; (2) under a letter of request, whether or not captioned as a "letter rogatory"; (3) on notice, before a person authorized to administer oaths either by the laws of the United States or of the place where the examination is held; or (4) before a person commissioned by the court to administer any necessary oath and take testimony.
(a) Using Depositions: At a hearing or trial, all or part of a deposition may be used against a party on these conditions: (1) the party was present or represented at the taking of the deposition or had reasonable notice of it; (2) it is used to the extent it would be admissible under the New Mexico Rules of Evidence as if the deponent were present and testifying; and (3) the use is allowed by Rule 1-032(A)(2) through (8).
(b) Objections to Admissibility: An objection may be made at a hearing or trial to the admission of any deposition testimony that would be inadmissible if the witness were present and testifying.
(A) Retention Requirements: Healthcare providers in New Mexico must retain medical records for a specified period:
(B) Electronic Records: Providers may maintain medical records in electronic form, and may destroy the original paper records if they have been securely digitized in compliance with New Mexico law.

The rule permits any party to take the deposition of another party, including depositions taken under Rule 1-030(B)(6) and depositions of disclosed experts, without the need for leave of court. This amendment, along with Rules 1-026 and 1-016, encourages the voluntary exchange of information between parties and requires counsel to consult before setting depositions. Refusal to agree to a reasonable and necessary deposition may subject counsel to sanctions under Rule 1-026(F).
