 a. Notice of Deposition (Rule 30(b))

• Requirement: A party desiring to take a deposition must give reasonable notice in writing to every other party involved in the litigation. The notice must state the time and place of the deposition, the deponent’s name, and the method of recording the testimony.

• Purpose: This ensures that all parties have sufficient time to prepare for the deposition and can attend or cross-examine the witness.

b. Examination and Cross-Examination (Rule 30(c))

• Requirement: The examination and cross-examination of a witness during a deposition follow the same procedure as would be used at trial under the Federal Rules of Evidence. Objections to the examination must be stated concisely and in a non-argumentative manner.

• Purpose: This provision ensures that the deposition process mirrors the courtroom experience, preserving the integrity of the testimony.

c. Recording of Deposition (Rule 30(b)(3))

• Requirement: The deposition may be recorded by audio, audiovisual, or stenographic means. The party who notices the deposition bears the cost of recording the testimony. If a party wishes to record the deposition by a method other than stenographic, they must inform the other parties in the notice.

• Purpose: This rule allows for flexibility in how depositions are recorded while ensuring transparency and fairness in the process.

d. Conduct During Depositions (Rule 30(d))

• Duration: A deposition is generally limited to one day of seven hours unless otherwise stipulated by the court or parties involved.

• Sanctions: The court may impose sanctions for any party or attorney who impedes, delays, or frustrates the fair examination of the deponent.

• Purpose: This rule is designed to prevent unnecessary delays and abusive practices during depositions, ensuring that the process is efficient and respectful.

e. Deposition by Written Questions (Rule 31)

• Requirement: Rule 31 allows for depositions by written questions instead of oral examination. The party conducting the deposition submits written questions, which are then asked by an officer present with the deponent.

• Purpose: This provides an alternative method to oral depositions, particularly useful when cost or logistics make in-person depositions difficult.


 a. Scope of Discovery (Rule 26(b)(1))

• Requirement: Parties may obtain discovery regarding any non-privileged matter that is relevant to any party’s claim or defense. This includes depositions.

• Purpose: This rule ensures that all relevant information is available for the discovery process, including through depositions.

b. Protective Orders (Rule 26(c))

• Requirement: A party or person from whom discovery is sought may move for a protective order. The court may, for good cause, issue an order to protect a party or person from annoyance, embarrassment, oppression, or undue burden or expense.

• Purpose: This rule allows parties to seek protection from abusive discovery practices, including depositions that may be conducted in bad faith or in a manner that is overly burdensome.


 a. Issuance of Subpoenas (Rule 45(a))

• Requirement: A subpoena may command a person to attend a deposition, produce documents, or permit inspection of premises. The subpoena must state the court from which it issued, the title of the action, and the court in which it is pending.

• Purpose: This rule grants the authority to compel the attendance of witnesses at depositions, ensuring that necessary testimony can be obtained.

b. Objections to Subpoena (Rule 45(d))

• Requirement: A person commanded to produce documents or tangible things or to permit inspection may serve a written objection to the subpoena. The court may then quash or modify the subpoena if it subjects a person to undue burden.

• Purpose: This rule provides a mechanism for challenging subpoenas that are overly broad or burdensome, protecting parties from unreasonable demands.

c. Sanctions for Non-Compliance (Rule 45(g))

• Requirement: The court may hold in contempt a person who, having been served, fails without adequate excuse to obey the subpoena.

Requirement: Witnesses attending a deposition under subpoena are entitled to a per diem for attendance and mileage reimbursement. The current rate is set by federal law.

• Purpose: This law ensures that witnesses are compensated for their time and expenses when attending depositions, making it easier for parties to secure necessary testimony.


Requirement: An attorney who multiplies the proceedings in any case unreasonably and vexatiously may be required to satisfy the excess costs, expenses, and attorneys’ fees incurred because of such conduct.

• Purpose: This statute discourages attorneys from engaging in abusive practices, such as unnecessarily prolonging depositions or engaging in improper conduct during them.


 Requirement: When depositions involve parties or witnesses located in foreign countries, the Hague Convention may apply. It governs how depositions are conducted internationally, including the methods for obtaining evidence and the cooperation of foreign authorities.

• Purpose: The Hague Convention facilitates international cooperation in gathering evidence, ensuring that depositions can be conducted across borders in a manner that respects the sovereignty of other nations.

Caption Legal provides professional legal videography, video editing, and transcript synchronization services on a nationwide basis. While Caption Legal specializes in these digital media services, we may, upon specific client request, provide administrative assistance in identifying and coordinating with independent, third-party court reporters for depositions, examinations under oath (EUOs), independent medical examinations (IMEs), and other legal proceedings.

2. Independent Contractor Status

Caption Legal is not a court reporting firm, agency, or a provider of certified shorthand reporting services. All court reporters identified or referred through our coordination assistance are independent professionals. These reporters are separately retained by, and contract directly with, the hiring party or their legal counsel.

3. No Employment or Agency Relationship

Caption Legal does not employ, supervise, control, or exercise direction over the work product, methods, or professional conduct of any independent court reporter. Furthermore, Caption Legal does not guarantee:

  • The availability or punctuality of any third-party reporter.
  • The performance, accuracy, or quality of transcripts produced.
  • Compliance with specific jurisdictional or professional standards by the reporter.

4. Client Responsibility and Due Diligence

Any coordination or referral provided by Caption Legal is offered solely as a convenience. The client (or their representative) bears the exclusive responsibility for:

  • Selecting and engaging the court reporter.
  • Verifying that the retained reporter maintains all necessary licenses, certifications, and legal credentials required by the relevant jurisdiction.
  • Ensuring the reporter’s services meet the specific requirements of the case or proceeding.

5. Compensation and Billing Transparency

Caption Legal does not share in, mark up, or receive any undisclosed commission or compensation from court reporter fees. In accordance with applicable laws and regulations, all billing for shorthand reporting services is handled independently of Caption Legal, unless a separate, express written agreement stipulates otherwise.

6. Limitation of Liability

Nothing contained on this website or in any communication from Caption Legal shall be construed as a contract or offer to provide court reporting services. Caption Legal expressly disclaims any and all liability arising from, or related to, the acts, errors, omissions, delays, or professional negligence of any third-party court reporter. This includes, but is not limited to, failures to comply with statutory rules, filing deadlines, or professional stenographic standards.

7. Acknowledgment of Limited Role

By engaging Caption Legal for videography or related media services, the client acknowledges and agrees that Caption Legal’s role is strictly limited to the provision of video-related services and optional administrative coordination. All court reporting services are provided exclusively by independent third parties.
